Client situation
Our client, a research-based pharmaceutical company, participated in a public tender for diagnostics. However, the specific tender conditions were unfavorable for our customer’s products compared to those of competitors. Our customer decided to take legal action against the tender procedure.
Our solution
We prepared a comprehensive medical-scientific expert opinion, which became an important part of the statement of claim of the lawyers commissioned by our client. In the expert opinion, we used well-founded arguments to demonstrate that the tender conditions were questionable from a medical-scientific point of view. In addition, we supported our client in the oral hearing before the Public Procurement Chamber in Bonn as a private expert.
